Terms of Use

The terms for using Kaguya.

1. About these terms

These terms are an agreement between you and Kakuno LLC (Kakuno合同会社) (“we” or “us”) for Kaguya. By creating an account or signing in, you accept them. Our Privacy Policy explains how we handle your information.

2. Your account

You must be at least 18 years old. If the age of adulthood where you live is higher than 18, you also need permission from a parent or guardian until you reach it.

Keep your sign-in methods secure. If you do not, you are responsible for what happens in your account as a result.

3. Your content

You keep any rights you have in what you save. You allow us to store, copy, and process it only to provide Kaguya to you, including the AI features you turn on, and to keep Kaguya secure. It is your responsibility to make sure you have the right to save it. Keep your own copy of anything important; you can export your notes at any time.

4. Rules for using Kaguya

Do not use Kaguya to store or share illegal content, infringe others’ rights, spread malware, access data that is not yours, or disrupt Kaguya.

We do not monitor what you save for breaches of these terms. We restrict content or an account only:

  • when an authority orders us to;
  • when we receive a credible report of illegal content;
  • after a serious or repeated breach of these terms, including use by someone under 18; or
  • to protect Kaguya’s security.

A person, not an automated system, makes each such decision, and we will tell you the reason unless the law prevents it. To report illegal content, write to support@kaguya.space and include where the content is, why you believe it is illegal, your name and email address, and a statement that your report is accurate and complete to the best of your knowledge. To appeal a decision, write to the same address.

5. AI features

AI features are optional. Their results can be wrong or incomplete and are not professional advice; check anything important before relying on it.

6. Kaguya Plus

Kaguya Plus is a subscription sold through the app store you use, at the price shown before you buy. It renews automatically until you cancel. The store handles payment, cancellation, and refund requests under its own terms; on Apple’s App Store, cancel in your Apple Account settings at least 24 hours before the current period ends. This does not limit any refund the law gives you. What each plan includes is shown in the app. When your Kaguya Plus subscription ends, nothing you saved is deleted.

We may change the price of Kaguya Plus. A new price applies only from a renewal after you have been told in advance, by us or the store, and you can cancel before then; where the store asks for your agreement, the new price applies only if you agree.

7. Changes to Kaguya

We may change or remove features for a valid reason, such as adding features, improving security, complying with the law, or a change in a service we rely on. We do not charge extra for these changes. Kaguya may also be interrupted for maintenance or for reasons beyond our control.

If a change makes Kaguya worse for you in more than a minor way, we will tell you in advance, and within 30 days of the change you can end your subscription and ask the store for a refund of the rest of the period. If we stop offering Kaguya, we will stop selling Kaguya Plus and tell you at least 90 days in advance so that you can export your notes; for any paid period that would remain, you can ask the store for a refund.

8. Closing your account

You can stop using Kaguya and delete your account at any time. Deleting your account does not cancel a Kaguya Plus subscription; cancel it where you bought it. We may suspend or close an account for the reasons in Rules for using Kaguya, and we will tell you why unless the law prevents it.

9. Ownership and license

Kaguya and its name belong to us. We give you a personal, non-transferable license to use the Kaguya app under these terms. For the app from Apple’s App Store, you may use it on Apple-branded products you own or control, as the Usage Rules in the Apple Media Services Terms and Conditions allow, including by other accounts linked to yours through Family Sharing or volume purchasing.

Kaguya includes open-source software covered by its own licenses. You can find them in the Settings app under Kaguya.

10. Our liability

We provide Kaguya with reasonable care, but we cannot promise that it will always be available or free of errors.

We are fully liable for damage that we, our representatives, or the people who work for us cause intentionally or through gross negligence. If we are liable only because of slight negligence, our liability is limited to ordinary, foreseeable direct damage, up to whichever is greater: the amount you paid for Kaguya in the 12 months before the event that caused the damage, or 10,000 Japanese yen. This limit does not apply to death or personal injury, or where the mandatory laws that protect you do not allow it.

11. Apple and the App Store

This section applies to the Kaguya app from Apple’s App Store. These terms are between you and us, not Apple. We, not Apple, are solely responsible for Kaguya and its content, for its maintenance and support, and for handling any claim about it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws. Apple has no obligation to provide maintenance or support for Kaguya.

We, not Apple, are solely responsible for any product warranties, express or implied by law, to the extent they are not effectively disclaimed. If Kaguya fails to meet a warranty that applies, you may tell Apple, and Apple will refund the app’s purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for Kaguya, and any other claims, losses, liabilities, damages, costs, or expenses caused by a failure to meet a warranty are our responsibility, not Apple’s. If anyone claims that Kaguya, or your having or using it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling, and discharging that claim.

You confirm that you are not located in a country subject to a US government embargo or designated by the US government as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties. You must comply with the third-party terms that apply to your use of Kaguya. Apple and its subsidiaries are third-party beneficiaries of these terms; once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce them against you.

12. Law and disputes

These terms are governed by the laws of Japan, and the Tokyo District Court is the court of first instance. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can also take legal action in that country’s courts; where that law requires it, we will take legal action against you only in those courts.

13. Changes to these terms

We may change these terms when the change is in users’ general interest, or when it is reasonable and does not conflict with the purpose of these terms, for example to add features, improve security, or comply with the law. Before new terms take effect, we post them here with their effective date, and we will tell you about a significant change in advance, in the app or by email. If you do not agree, you can stop using Kaguya and delete your account before the change takes effect.

We may transfer these terms to a company that takes over Kaguya, provided it keeps your rights under them, and we will tell you before that happens.
